Terms and Conditions
These Terms and Conditions ("Terms") govern your access to and use of our Software as a Service (SaaS) platform ("we", "us", or "our"), including all cloud-based applications, APIs, and services we publish on our subdomains (collectively, the "SaaS Services").
By accessing or using the SaaS Services, you agree to these Terms. If you do not agree, do not use the SaaS Services.
1. The SaaS Platform
We provide a cloud-based Software as a Service (SaaS) platform. Access is granted on a subscription basis. We maintain a multi-tenant cloud environment where features, compute capacity, and storage are allocated according to your subscription tier.
We reserve the right to deploy updates, modify features, or apply rate limits to ensure platform stability and equitable resource distribution among all tenants.
2. Accounts and authentication
Some features require an account. You are responsible for providing accurate information, maintaining the security of your sign-in credentials, and all activity that occurs under your account. Notify us promptly if you suspect unauthorized access.
We may suspend or terminate accounts that violate these Terms or pose a security or abuse risk.
3. SaaS Subscriptions and Billing
Our SaaS offerings are billed on a recurring subscription basis (e.g., monthly or annually). Your subscription tier determines your allowed usage, seats, and feature access.
Fees are charged automatically in advance of each billing cycle.
We do not offer prorated billing. Changes to your subscription tier will take effect at your next renewal date.
We reserve the right to suspend API or application access if recurring payments fail.
Except where required by law, SaaS subscription fees are non-refundable once a billing period has commenced.
4. Acceptable use
You agree not to use the Services for any unlawful purpose, upload malware, attempt unauthorized access, reverse engineer, scrape, overload our systems, or upload content you do not have the right to use.
5. Check Your Drawings
Check Your Drawings compares two architectural drawing PDFs and produces a coordination overlay.
5.1 No professional advice
The Services are software tools only. Output is not architectural, engineering, or legal advice. You are solely responsible for reviewing, verifying, and approving any drawings before use on site or in contract documents. The Services shall not, under any circumstances, be used as the sole basis for construction decisions, structural modifications, or safety assessments.
5.2 Accuracy and limitations
Alignment and overlay results depend on the quality and content of uploaded PDFs. We do not guarantee that comparisons are correct or complete. Always review results manually.
5.3 Your content
You retain ownership of PDFs you upload. You grant us a limited license to process uploads solely to provide the comparison service, including temporary storage on our servers for up to approximately 24 hours.
6. Intellectual property
The Services, including software, branding, and documentation (excluding your uploads), are owned by us or our licensors and protected by applicable intellectual-property laws.
7. DISCLAIMERS, "AS-IS" PROVISION, AND ASSUMPTION OF RISK
ALL SOFTWARE, SERVICES, AND DELIVERABLES ARE PROVIDED STRICTLY "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. KUSHAL SAMANT ARCHITECTS EXPLICITLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOU ASSUME SOLE AND FULL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SERVICES, SOFTWARE, AND ANY GENERATED OUTPUTS. WE DO NOT WARRANT THAT ANY SOFTWARE OR SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR SUITABLE FOR YOUR SPECIFIC REQUIREMENTS.
8. ABSOLUTE LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KUSHAL SAMANT ARCHITECTS, INCLUDING ITS PROPRIETOR, EMPLOYEES, AND AFFILIATES, BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES) ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES OR SOFTWARE.
YOU AGREE THAT YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISSATISFACTION WITH THE SERVICES IS TO STOP USING THE SERVICES. UNDER NO CIRCUMSTANCES WILL OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR INR 5,000, WHICHEVER IS LESS.
9. INDEMNIFICATION AND HOLD HARMLESS
YOU AGREE TO FULLY INDEMNIFY, DEFEND, AND HOLD HARMLESS KUSHAL SAMANT ARCHITECTS AND ITS PROPRIETOR, EMPLOYEES, AND AFFILIATES FROM AND AGAINST ANY AND ALL CLAIMS, LAWSUITS, ACTIONS, DEMANDS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES) ARISING OUT OF OR IN ANY WAY CONNECTED WITH (A) YOUR ACCESS TO OR USE OF THE SOFTWARE OR SERVICES; (B) YOUR RELIANCE ON ANY OUTPUTS, DATA, OR DELIVERABLES WITHOUT INDEPENDENT MANUAL VERIFICATION PRIOR TO APPLICATION IN PHYSICAL CONSTRUCTION, ARCHITECTURAL PROJECTS, OR STRUCTURAL DECISIONS; (C) YOUR VIOLATION OF THESE TERMS; OR (D) YOUR INFRINGEMENT OF ANY THIRD-PARTY RIGHT. THIS INDEMNIFICATION OBLIGATION WILL SURVIVE THE TERMINATION OF THESE TERMS AND YOUR USE OF THE SERVICES.
10. Termination
You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms.
11. Governing law and disputes
These Terms are governed by the laws of India. Courts in Mumbai, Maharashtra, India shall have exclusive jurisdiction over disputes arising from these Terms.
12. Changes to these Terms
We may update these Terms from time to time. Continued use after changes constitutes acceptance.
